Special Immigrant Green Card Process

The special immigrant green card process allows certain foreign nationals to obtain permanent residency in the United States based on specific circumstances. The adjustment of status is normally processed after the foreign national has received an approval on the underlying petition. Some of these processes have no Filing Fees with the government. Below are the categories, requirements, costs, and typical processing times for each. The requirements below are normally used as the basis for obtaining the Special Immigrant Petition and are not necessarily the requirements to process an Adjustment of Status.

VAWA (Violence Against Women Act) Self-Petitioners

VAWA allows certain abused spouses, children, or parents of U.S. citizens or permanent residents to apply for a green card.

Requirements

  • Proof of abuse by a U.S. citizen or lawful permanent resident spouse, parent, or child
  • Evidence of the relationship to the abuser
  • Proof of good moral character

Cost: No Government Filing Fee; however you will need to pay for the Medical Exam with a USCIS Certified Provider

Processing Time: 24-36 months

Special Immigrant Juvenile Status (SIJS)

SIJS provides a pathway to a green card for minors in the U.S. who have been abused, abandoned, or neglected by a parent.

Requirements

  • Under 21 years of age and unmarried - at the time of filing for the Juvenile Petition
  • Court order from a state juvenile court indicating abuse, abandonment, or neglect
  • Best interest determination that return to home country is not advisable

Religious Workers

Eligible religious workers can apply for a green card if they have been working in a religious occupation in the U.S. for at least two years.

Requirements

  • Employment in a religious vocation or occupation
  • Two years of continuous religious work experience
  • Evidence of bona fide non-profit religious organization employment

Cost: $1440 for Adjustment, $260 for Work Permit, plus cost of Medical Exam with a USCIS Certified Provider

U Visa Holders

The U visa is for victims of certain crimes who have suffered mental or physical abuse and are helpful to law enforcement.

Requirements

  • Victim of qualifying criminal activity
  • Certification of helpfulness from law enforcement
  • Proof of substantial physical or mental abuse

T Visa Holders

The T visa is for victims of human trafficking who assist law enforcement in investigations or prosecutions.

Cancellation of Removal

Eligible for those in removal proceedings who meet specific residency and hardship criteria.

Requirements

  • 10 years of continuous physical presence in the U.S.

  • Demonstration of exceptional and extremely unusual hardship to a U.S. citizen or LPR relative
